Sheria ya uchawi Tanzania inahukumu mchawi akibainika kwa ushahidi ni kifungo cha miaka 7 au chini ya hapo kutegemea madhara aliyosababisha, ushahidi ni huu hapa chini wa sheria hiyo, iko chapter ya 18 na inaitwa THE WITCHCRAFT ACT

THE WITCHCRAFT ACT
An Act to provide for the punishment of witchcraft and of certain acts connected therewith.
[28th December, 1928]
1. This Act may be cited as the Witchcraft Act.
Interpretation

Cap.11 "instrument of witchcraft" means anything which is used or intended to be

used or is commonly used, or which is represented or generally believed to possess the power, to prevent or delay any person from doing any act which he may lawfully do, or to compel any person to do any act which he may lawfully refrain from doing, or to discover the person guilty of any alleged crime or other act of which complaint is made, or to cause death, injury or disease to any person or damage to any property, or to put any person in fear, or by supernatural means to produce any natural phenomena, and includes charms and medicines commonly used for any of the purposes aforesaid;
"police force" means the Tanzania Police Force;
"public officer" means any employee of Government or of a local

government authority;
"witchcraft" includes sorcery, enchantment, bewitching, the use of

instrument of witchcraft, the purported exercise of any occult power and the purported possession of any occult knowledge.

(d) advises any other person upon the use of witchcraft or any
2. In this Act unless the context otherwise requires–
"court" includes a local court as defined in the Magistrates Courts Act;
3. Any person who–
(a) by his statements or actions represents himself to have the

power of witchcraft;
(b) makes, uses, has in his possession or represents himself to

possess any instruments of witchcraft;
instrument of witchcraft; or
(e) threatens to use or resorts to the use of witchcraft or any instrument of witchcraft upon or against any person or property,
commits an offence under this Act.
4. Any person, otherwise than in the course of communicating information to or obtaining advice from a court, a member of the police force, a local government authority or any public officer–
  1. (a)  whether with or without any of the intents mentioned in subsection (1) of section 5, names or indicates any person as being a witch or wizard by imputing to him the use of witchcraft or any instrument of witchcraft with intent to cause injury or misfortune to any person or class of persons or to cause damage to any property; or
  2. (b)  with any of the intents mentioned in subsection (1) of section 5, names or indicates any person as being a witch or wizard,
commits an offence under this Act.
5.-(1) Any person who commits an offence under this Act with intent to cause death, disease, injury, or misfortune to any community, class of persons, person, or animal, or to cause injury to any property shall be liable to imprisonment not less than seven years.
(2) Any person who commits an offence under this Act without any intent such as is described in subsection (1) of this section shall be liable to a fine of not less than one hundred thousand shillings or imprisonment of not less than five years.
(3) The trial of a person for an offence punishable under subsection (2) shall not begin unless the consent of the Attorney-General or the Zonal State Attorney in-charge is obtained.
6. A person who abets or attempts to commit an offence under this Act commits such an offence.
7. Any person who employs or solicits any other person to resort to the use of witchcraft or any instrument of witchcraft for any purpose whatsoever commits an offence.
8.-(1) If it is reported to the District Commissioner that a person is suspected of practising witchcraft, and the District Commissioner, after due inquiry, is satisfied that the person so suspected causes or is likely to cause fear, annoyance or injury in mind, person or property to any other person by means of pretended witchcraft or is practising witchcraft for gain or reward, he may, for reasons to be recorded, order the person so suspected to

reside in any specified locality within his district until such order is varied or revoked, and further or in the alternative may order such person to report to the District Commissioner or to a local authority at such intervals not being less than seven days as he shall direct until such order is varied or revoked.
(2) Any order made under this section shall with the reasons therefor be forthwith reported by the District Commissioner to the Regional Commissioner of his Region.
(3) Every report made under subsection (2) shall be accompanied by a record of the inquiry.
(4) The Regional Commissioner may suspend, reverse or vary any order made under subsection (1) and shall report such order and the action taken thereon to the President, and any such order of the District Commissioner or Regional Commissioner may at any time be disallowed or varied by the President.
(5) The power of a Regional Commissioner to vary an order under this section shall include a power to direct that the person in regard to whom the order is made reside in any specified locality within the Region and shall report, at such intervals as aforesaid, to any District Commissioner or local authority in such locality.
(6) The power of the President to vary an order under this section shall include a power to direct that the person in regard to whom the order is made reside in any specified locality in Tanzania and report at such intervals as aforesaid to any District Commissioner or local authority in such locality.
(7) Any person who without lawful excuse refuses or neglects to obey an order lawfully made under this section is liable to a fine not exceeding one hundred and fifty shillings or to imprisonment of either description for a term not exceeding two months.
9. Nothing in this Act shall affect the liability of any person to any penalty which he may incur under any other law, provided that no person shall be punished twice for the same act.

 Uchawi nini na Historia yake kwa ufupi

Uchawi umekuwepo kati ya watu na mataifa mbalimbali tangu zama za kale. Tamaduni na desturi nyingi za watu wa kale kwa mfano za kuning’iniza vyuma vilivyoandikwa au kunakshiwa nukta au michoro ya kitu fulani, au kuchorwa michoro maalumu kwenye miili ya mtu, zimekuwa na mahusiano na uchawi. Watu wamekuwa wakitumia jambo hilo kwa ajili ya kukabiliana na roho chafu na mashetani. Kuhusiana na suala hilo Qur’an Tukufu imeelezea kisa cha Nabii Nuh (as) na kuashiria madhalimu na waovu walimtuhumu mtukufu huyo kwa uchawi. Mbali na Nabii Nuh, wachawi wa Firaun nao walitumia viini macho katika kukabiliana na Nabii Musa (as) ambapo walikusanya nguvu zao zote za kiuchawi kukabiliana na mtukufu huyo. Aidha tukiangalia kipindi cha Utume wa Nabii Sulaiman (as) tunakuta tena suala la uchawi na mazingaombwe likiwa limeshika kasi kiasi kwamba, katika kipindi hicho kulikuwepo kundi na watu maalumu ambao walikuwa wakijishughulisha tu na mambo hayo ya kiuchawi. Ni kwa ajili hiyo ndio maana nabii huyo wa Mwenyezi Mungu akatoa amri ya kukusanywa maandiko, makaratasi na zana zao zote na kuzifungia sehemu maalumu. Ukusanyaji huo huenda ulifanyika kwa madhumuni kwamba, kulikuwepo na njia ya kubatilisha uchawi huo kwenye makaratasi hayo. Hata hivyo baada ya kufariki dunia Nabii Sulaiman (as) kundi fulani la watu liliyatoa mafichoni makaratasi hayo na kuanza tena kueneza mafundisho ya uchawi baina ya watu. Hali hiyo iliwafanya baadhi ya watu kufikia hatua hata ya kumtuhumu nabii huyo wa Mungu kwamba hakuwa Mtume. Kama hiyo haitoshi watu hao walizua uzushi kwamba, Nabii Sulaiman alikuwa mtu wa kawaida aliyefikia utawala na nguvu kubwa kupitia uchawi na mazingaombwe. Ni kutokana na suala hilo ndipo hata kundi fulani kati ya Wana wa Israel wakafuata fikra hizo potofu na hivyo kujiingiza katika masuala ya kiuchawi na kukipa kisogo Kitabu Kitakatifu cha Taurati alichoteremshiwa Nabii Musa (as).

 

Wakati Mtukufu Mtume Muhammad (saw) alipoteuliwa na Mwenyezi Mungu kuwa Mtume na kuteremshiwa Qur’an ambayo ndani yake ilimtaja Nabii Sulaiman kuwa Mtume wa Mwenyezi Mungu, baadhi ya makuhani na wasomi wa Kiyahudi, walisikika wakisema: 'Hivi hamshangai kumsikia Muhammad akisema kuwa Sulaiman alikuwa Mtume katika hali ambayo alikuwa mchawi?' Kwa maneno hayo, viongozi wa Kiyahudi walikadhibisha utume wa Nabii Muhammad na wakati huo huo kuituhumu shakhsia takatifu ya Nabii wa Mwenyezi Mungu, Sulaiman (as).

Uchawi na mazingaombwe hutekelezwa kwa njia tofauti. Wakati mwingine uchawi hufanyika kwa kutumia maneno yasiyofahamika ambayo hutamkwa na muhusika, huku aina nyingine ya uchawi ikitekelezwa kwa kutumia maandishi fulani. Wakati mwingine ili uchawi uweze kuwa na taathira na nguvu, muhusika anapasa kutumia maneno au kubeba kitu chenye maandishi hayo ya kiuchawi. Mara nyingine uchawi na mazingaombwe hufanyika kwa mchawi kuyatumikisha majini na mashetani katika kufanya jambo fulani. Baadhi pia hutumia viini macho na hila maalumu kwa kitu kisichokuwa na ukweli kukidhihirisha katika fikra za watu kuwa ni cha ukweli. Aidha baadhi ya watu hutumia uwezo wa hali ya juu ulio kinyume na maumbile ya kibinaadamu, usioweza kutathminiwa na nyenzo za kimaada za kawaida.

Kwa mtazamo wa Qur’an Tukufu, baadhi ya uchawi ni kama tukio lililojiri baina ya Nabii Musa (as) na wachawi wa Firauni, ambapo kulitumika kiini macho katika kuwapotosha watu kuhusiana na muujiza wa nabii huyo. Qur’an inasimulia kuwa, Firaun aliandaa kikao kikubwa na kuwataka wachawi kukabiliana na nabii huyo wa Mwenyezi Mungu.  Wachawi hao wa Misri wakatupa chini kamba na fimbo zao na kutokana na umahiri waliokuwa nao, wakazifanya kamba zile kutembea mithili ya nyoka. Watu wakiwa katika hali ya kushangaa, Nabii Musa na kwa amri ya Mwenyezi Mungu, akatupa chini fimbo yake ambayo iligeuka na kuwa joka kubwa la kweli na la kutisha ambapo lilianza kumeza uchawi wa wachawi hao wa Firauni. Qur’an imeelezea kisa hicho katika aya kadhaa huku katika aya ya 66 ya Surat Twaha ikisema kuwa, kwa kiini macho kamba za wachawi zilionekana kuwa ni zenye kutembea. Mwenyezi Mungu anasema: “(Musa) Akasema; Bali tupeni nyinyi! Mara kamba zao na fimbo zao zinaonekana kwa uchawi, kuwa ni zenye kwenda mbio.” Aya ya 69 ya sura hiyo hiyo ya Twaha, inautaja uchawi kuwa ni vitimbi na hila tu kwa kusema: “Na kitupe kilicho kuumeni kwako, kitavimeza walivyovitengeneza, hakika walivyovitengeza ni hila za mchawi tu, na mchawi hafanikiwi popote aendapo.” Kuna aya nyingi za Qur’ani zinazozungumzia kwa upana zaidi suala la uchawi. Miongoni mwa aya hizo ni  aya zinazoelezea kadhia ya malaika wawili waliokuwa wakiitwa Haruta na Maruta. Kisa cha malaika hao kinarejea nyuma hadi katika zama ambazo uchawi ulikuwa umekithiri mno katika jamii. Mwenyezi Mungu aliwatuma malaika hao katika sura ya binaadamu ili wawafundishe watu njia za kubatilisha uchawi sanjari na kujikinga na shari na madhara yake. Kutokana na kwamba malaika wale katika kuwafundisha watu njia za kubatilisha uchawi huo, walilazimika pia kufafanua uchawi wenyewe, watu fulani walitumia vibaya mafundisho hayo na kujiingiza moja kwa moja kwenye uchawi. Suala lililowafanya hata kumtuhumu kwa uchawi Nabii wa Mwenyezi Mungu, Sulaiman (as).

Ili kujua asili ya uchawi na mazingaombwe, kumepokelewa riwaya kadhaa kutoka kwa maimamu watoharifu wa Nyumba ya Mtukufu Mtume (saw). Imepokelewa kuwa, mtu mmoja alimuuliza Imam Ja’far Swadiq (as) kwa kusema: Nini chanzo cha uchawi na ni vipi mchawi anaweza kufanya mambo ya ajabu? Imam akamjibu kwa kusema: “Uchawi una namna tofauti. Aina moja ya uchawi ina nafasi ya kitiba. Lakini katika hali ambayo ni kinyume chake. Yaani kama vile ambavyo madaktari hutafuta njia kwa ajili ya kuondosha ugonjwa na kurejesha afya kwa mgonjwa, wachawi nao hutafuta njia kwa ajili ya kumuondolea mwanadamu siha na afya yake. Aina ya pili ni kiini macho kwa kufanya haraka zenye kasi katika kutenda jambo lisilo la kawaida. Aina ya tatu ni uchawi wa kuwatumikisha mashetani.” Mwisho wa kunukuu. Mtu yule hakuishia hapo na akamuuliza tena Imamu: Je, mchawi anaweza kutumia uchawi wake kuigeuza sura ya mwanadamu kuwa mbwa au punda au mfano wa wanyama hao? Imam Swadiq (as) akasema: “Mchawi ni dhaifu zaidi ya hayo uliyoyasema, kuweza kugeuza umbile la mwanadamu alilomuumba nalo Mwenyezi Mungu….lau kama angekuwa anao uwezo huo basi angeweza pia kujiepusha kwanza yeye mwenyewe kutokana na uzee, umasikini na maradhi.” Mwisho wa kunukuu. Kwa ajili hiyo lau kama mchawi angekuwa na uezo wa kujivutia maslahi, au kujiepusha na madhara, basi kwa hakika angekaa kwenye kiti cha ufalme, au angeweza pia kuvumbua hazina kutoka ardhini na kuzitumia katika ustawi. Hii ni katika hali ambayo wachawi hawana uwezo wa kujiondolea matatizo hata ya kawaida.

 

Kwa msingi huo kwa kuzingatia kuwa uchawi na mazingaombwe ni wenye athari na matokeo mabaya, dini Tukufu ya Kiislamu na Qur'an kwa pamoja vinapinga kila aina ya mambo yaliyo batili na yasio sahihi kama vile dhulma, ukandamizaji ukiwemo uchawi sanjari na kusisitiza juu ya umuhimu wa kupambana na mambo hayo. Imepokewa hadithi na riwaya kutoka kwa viongozi wakubwa wa Kiislamu, zinazolaani vikali uchawi na kuukemea. Moja ya hadithi hizo ni hadithi ya Imam Ali bin Abi Twalib (as) inayosema: "Mtu yeyote anayejifundisha uchawi, mchache au mwingi, basi amekufuru. Na huwa amekata mawasiliano kati yake na Mwenyezi Mungu moja kwa moja." Mwisho wa kunukuu. Hivyo kwa mtazamo wa Uislamu, kufanya uchawi, kujifunza, kumfundisha mwingine na kupata maslahi kutokana na uchawi huo, ni haramu na ni miongoni mwa madhambi makubwa. Baadhi ya riwaya zimekutaja kusoma na kufundisha uchawi kuwa ni jambo linalomfanya mtu kuwa kafiri.

 

Aidha kwa mujibu wa maulama wa Kiislamu, kusoma, kufanya uchawi na kuroga ni haramu. Lakini kusoma elimu inayoweza kusaidia katika kubatilisha uchawi, si kosa. Kuna wakati kutokana na mazingira, mtu anaweza kujifunza uchawi kwa lengo la kubatilisha na kufichua uchawi au njama za kiuchawi hasa pale mtu mchawi anapotumia uchawi wake kupotosha fikra za watu. Kwa mujibu wa historia, mtu mmoja ambaye alikuwa akipata pato kupitia njia za kiuchawi alimwendea Imam Swadiq (as) na kusema: 'Shughuli yangu ilikuwa uchawi na nilikuwa nikitapa kipato kilichokuwa kikidhamini mahitaji yangu ya kimaisha na ni kwa mali hiyo ndio nilifanya ibada ya hija. Hata hivyo kwa sasa nimeachana na kazi hiyo na nimetubu. Je, kuna njia yoyote ya kuniokoa? Imam Swadiq (as) akamjibu: "Fungua mafundo ya uchawi kutoka kwa watu wengine, lakini usizifungie shughuli zao fundo la uchawi." Mwisho wa kunukuu.

 

Nukta nyingine ni hii kwamba, licha ya kwamba uchawi unaweza kuathiri katika maisha ya mwanadamu, lakini mtu anaweza kujiepusha na athari hizo hasi za kiuchawi. Kujikinga kwa dhati takatifu ya Mwenyezi Mungu ambayo ndio yenye athari halisi katika ulimwengu wa kimaada na kimaanawi, kuomba dua, kutoa sadaka, kusoma Qur'an, hususan Suratul-Falaq, Suratun-Naas na aya ya 51 na 52 za Suratul-Qalam, kunaweza kumuondolea mtu madhara ya uchawi.

Kwenye Biblia tunaona katika agano jipya na la kale wameutaja uchawi na hii inaonyesha uchawi upo kweli na wachawi wapo kila sehemu

Imeandikwa, Kumbukumbu la torati 18:9-13. "Utakapo kusha kuingia katika nchi akupayo Bwana, Mungu wako usijifunze kutenda kwa mfano wa machukizo ya mataifa yale asionekane kwako mtu ampitishaye mwanawe au binti yake katika motowala asionekane mtu atazamaye bao wala mtu atazamaye nyakati mbaya wala mwenye kubashiri wala msihiri, wala mtu alogaye kwa kupiga mafundo wala apandishaye pepo wala mchawi wala mtu awaombaye wafu." kwa maana mtu atendaye hayo ni chukizo kwa Bwana kasha ni kwa sababu ya hayo Bwana Mungu wako anawafukuza mbele yako. Uwe mkamilifu kwa Bwana Mungu wako."

Wanao fanya uchawi hawatauridhi ufalme wa Mungu. Imeandikwa. Wagalatia 5:19-21 "Basi matendo ya mwili ni dhahiri ndiyo haya uasherati, uchafu, ufisadi, ibada ya sanamu uchawi, uadui, ugomvi, wivi hasira fitina, faraka uzushi, husada, ulevi, ulafi na mambo yanayofanana na hayo. Katika hayo na waambia mapema kama nilivyokwisha kuwaambia watu watendao mambo ya jinsi hiyo hawatauridhi ufalme wa Mungu."

 

Hakuna mtu ajuaye sutakavyo kuwa sikuzijazo. Imeandikwa, Isaiya 8:19, "Na wakati watakapokuambia tafuta habari kwa watu wenye pepo na kwa wachawi waliao kama ndege na kunong'gona; Je! Haiwapasi watu kutafuta habari kwa Mungu wao, Je! Waende kutafuta habari kwa watu waliokufa kwa ajili ya watu walio hai."

Pupils who attend s unique ‘conclave’ magic schools are split into four ancient houses - Winds, Undines, Gnomes and Salamanders, and like Potter, students study a defence against the deadly Dark Arts.

Welcome to Witchschool UK

WitchSchool UK is the first truly online school dedicated to Wiccan, Pagan, and magical thought! We founded Witch School because we found that many people who wanted to learn about Wicca were unable to find good information or training, either because they were geographically isolated or because they simply could not find real-time teachers. Some of these people were seeking to make Wicca their spiritual path, others just wanted to learn more about what Wicca really is.

The Witch School system is highly interactive providing many different ways to truly learn about the Magical and Wiccan world. In order to provide you with the best possible learning experience we utilize the best of the current communication tools available as well as quality materials to create a educational environment second to none.

Madhara ni makubwa ya uchawi ndo maana Ulaya, Asia na Katika vitabu vya dini zote amri ya kunhukumu mchawi kama atapatikana kwa ushahidi ilikuwa kumuua kabisa ndo jibu kwani si rahisi kuacha na kutubu kwa mtaji huu wa shetani anavyokuwa amefunga mkatabu wa kufuru kubwa za kutisha na za ukatili wakati mwingine.
Sisi tumeamua kushugulikia tiba kwa waanga wa uchawi na kulogwa bila kujali ni dini gani kwa maana afya ni muhimu na serikali inajifanya haitambui lakini viongozi wanakwenda kimya kwenye waganga wa kuwatibu na wengine kulogana kwa ushirikina wa kutegemea waganga.

Taasisi yetu inatibu magonjwa ya kimwili yanayoonekana kwa vyombo vya kisasa au kwa macho na yale yasiyoonekana kwa vyombo vya kisayansi au kuhakikiwa kisayansi lakini kwa macho na dalili waweza kuhakiki magonjwa hayo.
